Dear Board Members:

As you no longer allow public comment, the only way I can get the following statement  of concern to you is by a letter and to the public is by a press release.  There is no point in coming to board meetings anymore as we cannot interact with the board and we can read your minutes on line.

We ask that you consider the following statement and act upon it:

We as concerned parents in Cook County wish to ask the Board to request the Illinois legislature to investigate and rewrite the Illinois DHFS Child Support Enforcement laws as they presently are both:

1)    Unconstitutional as the Separation of Powers Clause in the Constitution forbids the Judiciary from overseeing and administering legislative functions; the Illinois Supreme Court is unconstitutionally “administering” the Administrative Law Courts under under 750 ILCS 25/4-5, the “Expedited Child Support Act of 1990.”

Please note that the Judiciary may not oversee or administer a legislative body, especially because they would then have a conflict of interest when Petitions for Mandamus are filed in courts against this body (the DHFS Child Support Enforcement Administrative Law Courts). Also note that all other administrative law courts under Illinois statutes are administrated and overseen by administrative and not judiciary officer; and

2)    Discriminatory in that they accept cases in Title IV-D program from custodial parents but fail their statutory duty to hear requests from NON-custodial parents for reduction in child support due to change of circumstances (i.e. Hold hearings in DHFS Administrative Law Courts)  as required under 750 ILCS 25/5-2 (“Actions Subject to Expedited Child Support”).

Thus they abdicate their statutory duty for the Administrative Law Court Investigator under Child Support Enforcement Division of DHFS to investigate both parents ‘ financial situation and hold a hearing to recommend to the Trial Court in post-divorce proceedings changes in child support. The courts then usurp this power and refuse even to listen to the defamed NON-custodial parent.

Thus many NON-custodial parents are falsely accused of failing to pay excessive child support which they are unable to pay and DHFS is obtaining federal funds to assist NON-custodial parents in obtaining changes in child support to reasonable amounts, but not using these funds for that purpose. What are they using them for – judges and child reps penions?  Instead the Non-custodial parents are falsely labeled and defamed as “deadbeats.

Two examples of this lawlessness in the Cook County Courts that are affected by the dereliction of this statutory duty by DHFS and lawless rulings by judges are:

1)     Sandie, who stopped her preparation for a board exam in pediatrics and for licensure as a  physician to raise her children, while her ex-husband completed his exams and then after being fraudulently defamed and the custody of her children illegally removed from her due to false statements to the court by her ex-husband and the child representative, then the Trial Court has ordered her to  pay exorbitant child support “because you are a doctor”, while she is actually homeless due to this order and she is NOT a licensed doctor and cannot obtain high paying employment, at the same time that her ex-husband is a highly paid anesthesiologist and her children are being brainwashed against her through typical actions known as parental alienation.  The DHFS has yet to hear her case to reduce child support.

2)    David, who is falsely defamed by his ex-wife as dangerous because he is an ex-Marine, and therefore wrongfully and illegally upon the outrageous order of the Trial Court lost custody of his children. He had a serious injury to his back at work last year – and he therefore has been unemployed for nearly a year. Worker’s compensation has failed to OK his compensation and his union is litigating that issue so his income has been $0 for a year. Yet the Trial Court has ordered him to pay $420 in child support every two weeks for his two children who are in the custody of their mother who is a drug addict. David has NO other assets as his ex-wife was a compulsive spender and threw away over $200,000 of marital income causing them to remortgage their house and lose it in foreclosure. Yet the Trial Court has refused, even after receiving affidavits from others that she is a drug addict to have the mother tested or even examined by psychologists as well as refused to even allow to be filed, let alone hear a motion to reduce child support. Now the judge is threatening to jail David for failure to pay child support.

Please note that the NON-custodial parents then end up with wage garnishment and other orders requiring that they pay > 150 % of their income for child support and they are thrown in jail when they are unable to do this. Their parents and other relatives are then extorted to get them out of jail. Please note that the Federal Consumer  Protection Act, 15 U.S.C. § 1611 and 29 C.F.R Part 870 require that wage garnishment be for no more than 65 % of NET income! These Trial Court orders often say that NON-custodial parents must pay more than 150 % of their gross income for child support. Isn’t this extortion and federal funding fraud?

I hope your committee will strongly consider this suggestion and strongly advocate for investigation of this situation.

NOTE: These laws are applicable the moment an obligee (non-custodial parent) is placed into the State Disbursement Unit (in Illinois Department of Healthcare and Family Services [HFS]) for collection and distribution of child support and are available to ALL  PARENTS in divorce actions even if they are NOT on  public assistance (Public Aid), upon application by either parent, whereupon the Family Court loses jurisdiction to investigate and hear applications for change in child support unless the parents disagree with the recommendation of the HFS Child Support Unit Administrative Law Court (ALC), after the ALC investigates financial circumstances, holds a hearing and makes a recommendation to the  parties.  Then the parties may go back to the Family Court Judge (Trial Judge) for review of recommendations, evidentiary hearing, and decision on change in child support.

  1. my two babies were taken from me, March 2013, by a school official and police officer(resource officer)and a caseworker for CPS, only on false allegations made up, all by these officials, themselves! This is the most heart-wrecking scenario that any child or parent should ever have go through. And the worst part, is I, the one to protect them, is not in the control of our own rights or notice of any violations or harm they have, forever, caused our children, can be so hard the fight against. Please, there i no words to explain the love we share with our babies! and i am so in ?? I do believe that behind this, is some sort political, funding program giving to the county for their own economic gain. I’m very frightened because our babies are being hurt. Prayers to all and God please protect our children, when their own rights are ignored.

  2. Judge Michael Ian Bender needs to be removed from the bench! He rides on the reputation of his deceased father, Gerald Bender who I understand was an outstanding judge of over 30+ years! However, his dad would probably be turning over in his grave if he knew how corrupt his son is on the bench. Judge Bender is a judge in the Cook County 1st District parentage and child support court and he is very prejudice and bias to pro se litigants and mothers. It is believed that he has and is accepting bribes from litigants. He violates peoples civil rights and fails to enforce the law, he prefers to rule based on man or woman or whomever has the biggest dime. He does not act impartially to litigants, especially women and does not have a care in the world about the best interest of the children whose lives depend on his corrupt rulings. He unnecessarily drags out litigation proceedings and he does not comply with Illinois Statues.

    I have had a trial twice in my custody/child support case twice and I have won both cases but Judge Bender alters or modifies the Orders in the best interest of the Respondent versus the best interest of the child, therefore putting my child at risk of even more mental, emotional and physical danger. He allows the Respondent to violate almost every court order that is put in front of him with or without petition. He allows the Respondent to create false scenarios to accuse me of neglect, abuse, emotional harm, etc…. He proceeds with the allegations as if they are true and does not follow ILCS law that says the “Burden of Proof” must be asserted before Modification of custody can be made. He allows the Respondent to actively participate in Parental Interference against the mother of the child, the Petitioner and he does nothing but ignore the Petitioners petitions. He has basically allowed the Respondent to stalk the petitioner in an attempt to try to drum up falsehoods to create a case. He is basically re-trying the custody matter in a round about way, even though the Petitioner has won in court with 2 other judges twice! This is illegal. A person can not be tried twice for the same cause once a ruling has been determined. He falsifies information in his court orders to make it appear that the Petitioner is a horrible parent when in fact she is an excellent parent. He addresses every petition of the Respondent and his 3 attorneys, but ignores every petition of the Petitioner. Currently, the Petitioner has 3 petitions on the table, 2 of them were submitted at the beginning of August. He has only acknowledged one of them but that was over a month after the petition had been submitted. This petition was for emergency child support and medical. He finally set a date for December 9, 2013, that was on September 18, 2013. In the meantime, we have been to court at least 11 times including an emergency court intervention (with no evidence to justify the cause) but we can’t have a hearing on emergency child support. The Petitioner, has been forced to apply for welfare due to this action. While in the meantime the emergency intervention was a cause alleging medical neglect, but Judge Bender won’t make ruling on State statutory guidelines of support and medical from the other parent but he will try the mother for medical neglect even though there is no evidence, in fact the petitioner brought copies of the minor’s medical records and the medication that he had completed and Judge Bender refused to even look at the medicines but he read the entire petition of the Respondent and ordered the unnecessary court intervention. The other petition was a request to remove the child from the state of Illinois. He has totally ignored that one all to together, even though the move is only to Indiana less than 3 hours away. The 3rd petition was again for emergency child support and medical but again Judge Bender has ignored it as if it wasn’t even petitioned. However, we have been to court at least 11 times in the last month and a half and have another court date scheduled for November 12, 2013 all these are on petitions or no petition of the Respondent. I say no petition because Judge Bender will often make these verbal quasi petitions from the bench on behalf of the Respondent and run with them as if they have proven the allegations that are alleged. He needs to be removed from the bench NOW and not on December 6, 2013. I have heard he will be leaving. I think he needs to go now because he is acting in a vengeance against Prose litigants and female litigants. Judge Bender’s behavior is being discussed everywhere in the courts but nothing seems to be happening to remove him immediately because he is just a BAD JUDGE and COOK COUNTY has enough challenges with corruption in our court rooms, but to make the children suffer, this is not good! I have a happy, intelligent child but I need him out of court and in a stable, drama free home unlike that of the Respondent. This judge in 2011 took my son from me one day on Jan. 13th with no evidence of cause. Literally, I dropped my son off at school and didn’t see me again for over 4 months and when he was allowed to see me again, it was supervised for one Hour! All because Judge Bender allowed Dad, the respondent and his attorney accuse me of whipping my child with a belt. They never provided any evidence and DCFS cleared all allegations both times and found both cases to be simply not true and therefore rendered an “unfounded” report. Judge Bender should have returned custody to me but instead he ordered me to have supervised visitation. This had gone on for over 2 years until recently I had a 9 day trial and on June 4, 2013 another Judge ruled that I again have sole, legal and residential custody after hearing all the evidence presented in the trial this judge ordered the Respondent to pay several sanctions for his lack of concern for his minor child and for his foolishness and fraud he played on the court. Now Judge Bender is trying to do the same thing he did in 2011, overturn my custody and blatantly disregarding that a 9 day trial recently took place and blatantly disregarding that the Burden of Proof before Modification in a Custody Matter, and again disregarding that the other judge just ruled on June 4, 2013 in my favor that I have sole, legal and residential custody of the minor. This is a crooked judge and he needs to be REMOVED FROM THE BENCH, and not on December 6, 2013, but immediately!!!! He is destroying families everyday that he continues to sit on the bench!!!!

  3. all of the rotten apples including judge leida santiago should be removed from the court system since after her judgement I have also become homeless being deprived even of personal possessions.

  4. My son is going through a child custody case before the Judge Bonita Coleman John, and we would like to know who do we contact or write a letter too regarding this matter. My son is NOT getting treated fairly through this judge Bonita Coleman. I the mother of the non-custodial parent is writing this on behalf of my grandson as well as my son.
